In case we are acting as NVOCC, our services are subject to the terms and conditions of the carrier’s Bill of Lading and/or standard conditions of carriage of goods.

In case of freight forwarding services, not being subject to Bill of Lading- and/or standard conditions for carriage, we operate exclusively in accordance with the latest version of ALLGEMEINE DEUTSCHE SPEDITEURBEDINGUNGEN – ADSp – (GERMAN FREIGHT FORWARDERS‘ STANDARD TERMS AND CONDITIONS).

THE ADSp (SECTION 23) LIMIT THE LEGAL LIABILITY IN ACCORDANCE WITH §431 OF THE GERMAN COMMERCIAL CODE (HGB) FOR DAMAGE TO GOODS WHILST IN THE CARE OF A FORWARDER TO EUR 5,– PER KG.
IN THE CASE OF MULTIMODAL TRANSPORTS, INCLUDING SEA TRANSPORTS, TO 2 SPECIAL DRAWING RIGHTS (SDR) PER KG PLUS IN ADDITION PER DAMAGE OR EVENT TO EUR 1 MILLION OR 2 SDR/KG, WHICHEVER IS HIGHER.
PLACE OF JURISDICTION IS, UNLESS WE ARE ACTING AS AGENT ONLY, HAMBURG. ARBITRATION IS EXCLUDED.
